The Parties declare and acknowledge that the negotiations preceding the conclusion of this agreement were conducted in good faith and that they benefited, during the pre-contractual negotiation phase, from all the necessary information and useful to allow them to engage in full knowledge of the facts and to have mutually communicated any information likely to determine their consent and which they could legitimately ignore.
PREAMBLE:
Client requests different media .
The Client and the Service Provider conclude a contract for the realization of these different media.
The Service Provider accepts the conditions stipulated in the this contract for the production and creation of these media
The parties agree as follows:
ARTICLE 1: Object of the contract
The SOSMY BUSINESS Service Provider will create on behalf of the Client the media chosen by it in accordance with the conditions defined by this contract and for remuneration.

The PHOTOS MAPS Service Provider will create on behalf of the Client the media chosen by it in accordance with the conditions defined by this contract and for remuneration.
ARTICLE 3: Price
A: Basic Package
The price of the Basic Pack depends on the Square footage of property:
up to 50m² > 290€
from 51 to 100m² > 390€
from 101 to 200m² > 490€
from 201 to 400m² > 590€
from 401 to 600m² > 690€
from 601 to 800m² > 790€
from 801 to 1000m² > 890€
B: Standard Pack
The Standard Pack price depends on the area of the establishment:
up to 50m² > 380€
from 51 to 100m² > 480€
from 101 to 200m² > 580€
from 201 to 400m² > 680€
from 401 to 600m² > 780€
from 601 to 800m² > 880€
from 801 to 1000m² > 980€
C: Premium Pack
The price of the Premium Pack depends on the Square footage of property:
up to 50m² > 470€
from 51 to 100m² > 570€
from 101 to 200m² > 670€
from 201 to 400m² > 770€
from 401 to 600m² > 870€
from 601 to 800m² > 970€
from 801 to 1000m² > 1070€
D: Media Updates
These updates are optional and without time commitment. The price of these updates is only valid for an establishment that is already virtualized.
ARTICLE 4: Terms of payment
The Customer will pay the amount indicated in the shopping cart of the Stripe payment gateway by credit card in return for the service provided by the Service Provider.
ARTICLE 5: Duration
The creation of the media set should be completed no later than 48 time from contract signing.
The Customer may not oppose any to the recognition of the completion of the creation.
ARTICLE 6: Obligations of the Service Provider
The Service Provider undertakes to create media in accordance with this Agreement.
ARTICLE 7: Customer Obligations
The Customer agrees to pay the price of the service provided by the Service Provider.
ARTICLE 8: Responsibility
The Service Provider’s contractual obligation is a obligation of means. He undertakes to implement all necessary means to achieve the objectives stipulated in this contract.
The Service Provider does not guarantee the Client a result. If the objective is not achieved, the Service Provider cannot be held liable on this basis. To engage the Service Provider’s liability, the Client must demonstrate its lack of diligence in its attempt to perform the obligation.
The Client assumes full responsibility information that it will disseminate on the various media after they are put online.
The Client shall respect all of the legislation in force relating to data processing, files and freedoms.
ARTICLE 9: Intellectual Property
The Customer remains the owner in all cases of all the information provided to the Service Provider. This includes information of any kind and in any format.
By this contract, the Customer has media via his Google Maps business listing, he may not under any circumstances make captures allowing him to reuse these copies on other platforms. If he wishes to obtain the photos and videos, the Customer must choose the “forever” payment option in order to have these full rights.
ARTICLE 10: Privacy
The parties are bound by a duty of confidentiality concerning the documents, systems, software and know-how emanating from the other contracting party. Confidentiality takes effect throughout the duration of the contract and after its expiration.
ARTICLE 11: Termination
In the event of non-performance or improper performance of the obligations stipulated in this contract by one of the parties, a formal notice will be sent by registered mail with acknowledgment of receipt notifying the breach.</span >
If within 15 days of from the receipt of the formal notice no solution is found by the parties, this contract will be terminated.
ARTICLE 12: Dispute and Jurisdiction
The law applicable to this contract is French law.
In case of dispute, the parties agree to seek an amicable solution. If the process fails, the dispute will be settled by the Judicial Court of Paris.
ARTICLE 13: Period of trial
The Service Provider offers the Client the possibility of view the virtual tour before the broadcast on Google Maps. The customer has a maximum of 8 days to be able to broadcast the virtual tour on Google Maps. Beyond this period, if no order has been made, the virtual tour is automatically deleted. The Customer may at any time request the deletion of the Google Maps virtual tour by sending an email to contact@photos-maps.com.
